By accessing or using the services provided by 12Testers ("we", "our", "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use our services. These Terms constitute a legally binding agreement between you (the "User" or "Client") and 12Testers.

2. Description of Service

12Testers provides professional Android and mobile game testing services ("Services") that include but are not limited to:

  • Standard App Testing: Comprehensive testing of Android applications by a team of qualified testers on real devices for a period of 14 days, with access to 12+ professional testers.
  • Game Testing: Specialized quality assurance testing for mobile games, including gameplay mechanics evaluation, performance analysis, bug detection, multi-device compatibility testing, and real gamer feedback.
  • Google Play Console Assistance: Guidance and support for meeting Google Play Store requirements and production deployment.
  • Detailed Reporting: Comprehensive test reports including bug descriptions, severity ratings, screenshots, video recordings, device compatibility results, and performance metrics.

The specific features and scope of testing will depend on the plan selected by the User (Starter, Professional, or Game Testing).

3. User Obligations

As a User of our Services, you agree to:

  • Accurate Information: Provide accurate, complete, and up-to-date information about your application, including package name, version details, and testing requirements.
  • Google Play Console Access: Add our designated tester email addresses to your Google Play Console as internal testers or closed testing track participants within 24 hours of receiving the tester list. Failure to do so may delay testing and will not extend the testing period.
  • App Availability: Ensure your application is accessible to our testers throughout the entire testing period. Any downtime or access issues on your end will not extend the testing period.
  • Payment: Pay all fees associated with the selected service plan in full before testing begins. All prices are listed in USD and are subject to applicable taxes.
  • Compliance: Ensure your application complies with all applicable laws, regulations, and Google Play Store policies. We reserve the right to refuse testing services for applications that violate laws, contain malicious code, or promote illegal activities.
  • Communication: Respond to our communications in a timely manner and provide any additional information or clarifications requested during the testing process.
  • Prohibited Content: Not submit applications containing illegal content, malware, viruses, or content that infringes on third-party intellectual property rights.

4. Payment and Refunds

4.1 Pricing

Our pricing is clearly displayed on our website and varies based on the selected plan:

  • Starter Plan: $32.00 per app
  • Professional Plan: $52.00 per app
  • Game Testing Plan: $129.99 per game

Prices are subject to change with 30 days' notice. Changes will not affect services already purchased.

4.2 Payment Terms

Payment must be made in full before testing services commence. We accept major credit cards, debit cards, and other payment methods as displayed on our website. All payments are processed securely through Stripe.

4.3 Refund Policy

We offer a 100% money-back guarantee under the following conditions:

  • Refund requests must be made within 7 days of the testing start date.
  • Refunds are granted if we fail to deliver the agreed-upon testing services or if you are not satisfied with the quality of our service.
  • Refunds will not be issued if testing delays are caused by the User's failure to provide necessary access, information, or timely responses.
  • Refunds are processed within 10 business days to the original payment method.

5. Intellectual Property

5.1 User Content

You retain all ownership rights to your application, including all intellectual property rights. By using our Services, you grant us a limited, non-exclusive, royalty-free license to access, test, and analyze your application solely for the purpose of providing our testing services.

5.2 Confidentiality

We treat all User applications and related information as confidential. All testers sign non-disclosure agreements (NDAs) and are contractually obligated to maintain confidentiality. We will not share, distribute, or disclose your application or any information about it to third parties without your explicit consent, except as required by law.

5.3 Service IP

All intellectual property rights in our Services, website, testing methodologies, reports, and related materials remain our exclusive property. You may not copy, modify, distribute, or create derivative works based on our Services without our prior written consent.

6. Testing Process and Deliverables

6.1 Testing Period

The standard testing period is 14 days from the date testers receive access to your application. The testing period begins once you have added all tester emails to your Google Play Console and confirmed access.

6.2 Critical Bug Reporting

Critical bugs (crashes, security vulnerabilities, data loss issues) will be reported immediately via email. You may submit a fixed build at any time during the testing period, and we will re-test the affected areas at no additional charge.

6.3 Final Report

Upon completion of testing, you will receive a comprehensive report including:

  • Detailed bug descriptions with severity ratings
  • Screenshots and video recordings of issues
  • Device compatibility matrix
  • Performance metrics (where applicable)
  • Recommendations for improvements

Reports are delivered within 2 business days after the testing period ends.

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

  • Our Services will be uninterrupted, timely, secure, or error-free
  • The results obtained from using our Services will be accurate or reliable
  • All bugs or issues in your application will be discovered during testing
  • Your application will be approved by Google Play Store or any other platform

While we strive to provide thorough and professional testing services, we cannot guarantee that all issues will be identified. Testing is inherently limited by time, resources, and the complexity of software applications.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 12TESTERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use our Services
  • Any unauthorized access to or use of your application
  • Any bugs or issues not discovered during testing
  • Any rejection of your application by app stores or platforms
  • Any conduct or content of any third party using our Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO 12TESTERS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless 12Testers, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:

  • Your violation of these Terms
  • Your application or its content
  • Your violation of any third-party rights, including intellectual property rights
  • Your violation of any applicable laws or regulations

10. Data Security and Storage

We implement industry-standard security measures to protect your application and data:

  • All application files are stored on encrypted servers
  • Access is restricted to authorized testers only
  • All testers sign NDAs and confidentiality agreements
  • Application files and test data are permanently deleted within 30 days after testing completion

While we take reasonable precautions to protect your data, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

11. Termination

11.1 Termination by User

You may request to cancel testing services within 7 days of the testing start date for a full refund, subject to our refund policy. After 7 days, no refunds will be provided for cancellations.

11.2 Termination by 12Testers

We reserve the right to suspend or terminate your access to our Services immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms
  • Submission of applications containing illegal or malicious content
  • Fraudulent payment or chargeback attempts
  • Abusive or threatening behavior toward our staff or testers

In case of termination for cause, no refunds will be provided.

12. Modifications to Services and Terms

12.1 Service Changes

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of our Services.

12.2 Terms Updates

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website and updating the "Last Updated" date. Your continued use of our Services after such changes constitutes your acceptance of the new Terms.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

13.2 Dispute Resolution

Any disputes arising out of or relating to these Terms or our Services shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through binding arbitration in accordance with the rules of the London Court of International Arbitration (LCIA).

13.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on our website, constitute the entire agreement between you and 12Testers regarding our Services.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

14.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without our prior written consent. We may assign these Terms at any time without notice.
